Order Terms & Conditions
The online shop is owned and operated by or on behalf of Top Label International Limited (collectively "we", “us”, the "Company", "Top Label" ). We provide the content and services on this shop. By accessing and purchasing in this shop, you are acknowledging that you have read, understood, and agreed, to be bound by these terms and conditions which shall be amended from time to time at our sole discretion.
1 On-Line Shop
1.1 Product pictures at Top Label On-Line Shop are for reference only. The colors and packaging of the products may be slightly different from the pictures. Please refer to the actual product.
1.2 After you have submitted the order, we will send an order confirmation letter to you by email or fax within 1 to 2 working days.
1.3 We shall make every effort to ensure products displayed on this shop are in stock.
1.4 All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.
1.5 In situation where there are limitations, price, promotion offers and other marketing campaigns on the this On-Line Shop may varies from retail stores, the terms and offers are only applicable to this On-Line Shop.
2 Registration
2.1 You are required to register as a Top Label Shop Member online and agree to provide accurate, complete and up-to-date information for registration on this shop before placing an order.
2.2 You should provide us with your full name in order to verify your identity during delivery or self pickup of goods.
2.3 You should safeguard your username and password.
2.4 You authorize us to assume that any person using Top Label On-Line Shop with your username and password is either you or is authorized to act for you.
2.5 We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
2.6 If there are any changes to the information that you provided, please log in your account and update the information immediately, or inform us by phone or email so that we can communicate with you effectively.
3 Payment Terms
3.1 We accept payment by Visa card or PayME. All product prices listed are in HK dollars. The prices charged are those applicable on the day you order.
3.2 Acceptance of orders is subject to our sole discretion. A final receipt will be issued to you when goods are delivered to your address.
4 Exchange Policy
4.1 It is your responsibility to check the condition of any goods received at the time of delivery. If the goods are defective, damaged or not what you ordered, please contact us immediately for an exchange. Any other reasons will not be accepted for exchange.
4.2 The following items cannot be returned due to hygiene and food safety concerns:
i. All personal hygiene products and consumables (such as hand sanitizers, masks, etc)
ii. All food and beverages
4.3 All returned goods must be unused and the original packaging, tags and parts must be intact. Goods that have been opened, used, damaged or have missing parts cannot be replaced.
4.4 In the event that you would like to claim an exchange, please contact us within 7 days from the date of delivery. We will require valid receipt and photo evidence of the faulty products. No exchange will be available after the 7-day period.
4.5 Please return the products to this address within 7 days from the request for an exchange:
Unit M, 1/F., Kaiser Estate, Phase 3, 11 Hok Yuen Street, Hunghom, Kowloon, Hong Kong
The customer must bear all transportation costs and risks involved in the process of returning the goods.
4.6 Only one exchange request can be made per each order which may include several products.
4.7 You can only exchange your product for the same model.
4.8 Refund policy is not available.
5 Variation/cancellation of order
5.1 All orders shall not be varied or cancelled upon payment settlement.
5.2 We may substitute the product you ordered that is not in stock with a similar product upon your consent. Otherwise, the unavailable product will be refunded accordingly.
5.3 Without your prior consent for a substitution, no substitution will be made.
6 Privacy Policy
6.1 We are committed to safeguarding the privacy of individuals with respect to your personal data. We shall keep your personal data confidential and shall ensure that our policies and practices with respect to the collection, use, retention, disclosure, transfer, security and access of your personal data comply with the requirements under the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong.
6.2 We may use the personal data collected only for the purposes of providing sales, promotion and customer services.
7 Force Majeure
We shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, strikes, or any other causes beyond the control of us.
8 Disclaimer of Warranties and Limitation of Liability
8.1 We do not represent or warrant that access to our site (including using our applications or software), or any part of it, will be uninterrupted, reliable or fault-free.
8.2 We do not represent or warrant to you that our site or any of its contents will be accurate, complete or reliable.
8.3 We do not represent or warrant that:
8.3.1 any services (whether or not provided by us) will be provided with due care and skill; or
8.3.2 any merchandise (whether or not provided by us) will be of merchantable quality or will be fit for any purpose (even if that purpose has been previously notified to us).
8.4 You agree that no data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Any information which you transmit to us is transmitted at your own risk.
8.5 To the extent permitted by law, we exclude all liability (whether arising in contract, tort or otherwise and whether or not due to our negligence) which we may otherwise have to you as a result of:
8.5.1 any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to our site (including using our applications or software) or any information on our site;
8.5.2 the unavailability of our site (or any part of it), merchandise or services;
8.5.3 any delay in providing, or failure to provide or make available, merchandise or services, or any negligent provision of merchandise or services;
8.5.4 any merchandise not being of merchantable quality or fit for their intended purpose; or
8.5.5 any misrepresentation on or relating to our site, the merchandise or the services.
8.6 Save as required by law:
8.6.1 we will not be liable to you for any indirect or consequential loss, damage or expenses, including loss of profits, business or goodwill, arising out of any problem you notify to us, and
8.6.2 we will have no liability to pay any money to you by way of compensation except otherwise specified in these terms and conditions.
8.7 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase merchandise from our site. We make no representation and accept no liability in respect of the export or import of the merchandise you purchase.
8.8 You agree that each of these limitations is reasonable having regard to the nature of our site and in particular given that when you purchase merchandise through our site you will enter into a separate contract with the supplier in each case.
8.9 None of the above exclusions shall affect any statutory rights which are not capable of being excluded. However, in such case our obligation, where permitted by law, will be limited to the resupply of our services or the merchandise to you.
8.10 Each of the above exclusions or limitations shall be construed as a separate, and severable, provision of these terms and conditions.
8.11 We reserves the right to revoke any stated offers, cancel any orders and correct errors, inaccuracies or omissions on the online shop at any time. In such cases, we will contact you immediately.
9 In case of any dispute, the company reserves the right of final decision.
10 If there is any inconsistency or ambiguity between the Chinese and English versions, the Chinese version shall prevail.

4 Exchange Policy
